Once we receive your complete DMCA complaint, we will investigate the claim and take appropriate action, which may include removing or disabling access to the infringing material.
Counter-Notification Procedure
If you believe that the content you posted on CaptionWhiz.com was removed or disabled in error, you may submit a counter-notification.
Your counter-notice must include the following information:
- Identification of the material: Describe the material that was removed or disabled and specify where it was before it was removed.
- Your contact information: Provide your full name, address, phone number, and email address.
- Statement of good faith: Include a statement that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
- Consent to jurisdiction: Include a statement that you consent to the jurisdiction of the federal court in your district (or the district where your address is located if outside the United States) and that you will accept service of process from the person who filed the original DMCA complaint.
- Signature: The notice must be signed (either physically or electronically).
Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA complaint.
If that party does not file a lawsuit within 10 business days, we will restore the removed content.
Repeat Infringers
CaptionWhiz.com reserves the right to terminate the accounts of users who are found to be repeat infringers of copyright laws.
